Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and CC Entertainment PTY LTD, doing business as SkinNit ("SkinNit", "we", "us", or "our"), concerning your access to and use of https://skinnit.co.za and any related media channel, mobile website, mobile application, or connected service (collectively, the "Site").

By accessing or using the Site, you agree that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with all of these terms, you are prohibited from using the Site and must discontinue use immediately.

We may update these Terms of Service from time to time. We will alert users to changes by updating the "Last updated" date above. Your continued use of the Site after revised terms are posted means you accept the revised terms.

The Site is intended for users who can lawfully access and use it. Users who are minors in their jurisdiction must have permission from, and be supervised by, a parent or guardian.

Intellectual Property Rights

Unless otherwise indicated, the Site and all source code, databases, functionality, software, website designs, text, photographs, graphics, logos, trademarks, and other content on the Site are owned or controlled by us or licensed to us. The content is protected by South African and international intellectual property laws.

You may access and use the Site for personal, non-commercial use only. No part of the Site, content, marks, designs, or materials may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for commercial purposes without our prior written permission.

User Representations

By using the Site, you represent and warrant that any registration or purchase information you submit is true, accurate, current, and complete; that you have the legal capacity to agree to these terms; that you will not use the Site for any illegal or unauthorized purpose; and that your use of the Site will not violate any applicable law or regulation.

You are responsible for keeping account login details confidential and for all activity that occurs under your account.

Products

We make every effort to display product colors, features, specifications, and details as accurately as possible. However, we do not guarantee that all product colors, features, specifications, or details will be accurate, complete, reliable, current, or free of errors. Your device screen may not accurately reflect actual product colors or details.

All products are subject to availability. We may discontinue products at any time and prices may change without notice.

Purchases and Payment

We currently accept payment through Ozow Secure Payment Gateway and EFT Direct payment. Payment data needed to process purchases may be collected by the relevant payment provider. Ozow's privacy notice is available at https://ozow.com/privacy-policy/.

You agree to provide current, complete, and accurate purchase, account, billing, and shipping information for all purchases made through the Site. All payments are processed in South African Rand. Applicable taxes and shipping fees may be added to your order.

We reserve the right to correct pricing errors or mistakes, even if payment has already been requested or received. We may refuse, limit, or cancel any order placed through the Site at our discretion, including orders that appear to be placed by dealers, resellers, or distributors.

Return Policy

We hope you are happy with your purchase. If you are not completely satisfied with your purchase, you may request a return for a refund, store credit, or exchange, subject to the conditions below.

All returns must be postmarked within seven (7) days of the purchase date. Returned items must be in new and unused condition, with all original tags, labels, and packaging included where applicable.

To start a return, please contact SkinNit support to request a Return Merchandise Authorization (RMA) number:

You are responsible for return shipping charges unless otherwise confirmed by SkinNit support. We strongly recommend using a trackable shipping method for returns.

Refunds and Exchanges

After receiving your return and inspecting the condition of the item, we will process your refund, store credit, or exchange. Please allow at least two (2) days from receipt of the item for processing. Refunds may take 1-2 billing cycles to appear on your statement, depending on your payment provider. We will notify you by email when your return has been processed.

For defective, damaged, or incorrect products, please contact SkinNit support with your order number and photos so we can assist with a refund, replacement, or exchange where applicable.

Shipping Policy

SkinNit offers door-to-door delivery within South Africa. Delivery is made to the address provided when the order is created. Orders usually take 1-3 business days to deliver, depending on your delivery address, product readiness, and courier availability.

SkinNit currently delivers only within South Africa.

Local shipping for Johannesburg and surrounding areas is R100.00 including VAT. National shipping for areas such as Durban, Cape Town, and other non-local South African areas is R140.00 including VAT.

Items under R1000 are insured as part of the shipping cost. Items over R1000 are not automatically insured unless the customer requests insurance where applicable. SkinNit will not be held responsible for theft or damage to goods while in transit with the shipping provider if no insurance is requested.

Prohibited Activities

You may not use the Site for any purpose other than the purpose for which it is made available. You agree not to misuse the Site, interfere with its security or operation, collect data without permission, impersonate others, use automated bots or scraping tools, upload malicious code, submit false information, harass staff or other users, copy or adapt Site software, or use the Site in a way that violates any applicable law or regulation.

User Generated Contributions, Reviews, and Submissions

If the Site allows you to submit reviews, comments, designs, images, feedback, suggestions, or other materials, you are responsible for ensuring that you have the rights and permissions needed to submit them. Your submissions must not infringe third-party rights, be false or misleading, contain illegal or harmful material, or violate these Terms of Service.

By submitting content to us or through the Site, you grant us the rights needed to host, use, reproduce, display, adapt, and distribute that content for the purposes connected to operating, marketing, and improving SkinNit, subject to applicable law.

We may accept, reject, edit, or remove reviews or other user submissions at our discretion.

Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms of Service. The Site and services are operated from South Africa. If you access the Site from another region, you consent to the transfer and processing of your data in South Africa where applicable.

Site Management, Modifications, and Termination

We reserve the right to monitor the Site, manage access, remove content, correct errors, update information, modify products or services, suspend or discontinue parts of the Site, and deny access to the Site at our discretion where permitted by law.

We cannot guarantee that the Site will be available at all times. We may experience downtime, maintenance, delays, or technical errors.

Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of South Africa. CC Entertainment PTY LTD and you agree that the courts of South Africa shall have jurisdiction to resolve disputes arising from these terms or your use of the Site, subject to applicable law.

Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions relating to products, pricing, availability, or other information. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

Disclaimer

The Site is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim warranties, express or implied, in connection with the Site and your use of it. We do not guarantee that the Site content will be complete, accurate, uninterrupted, secure, or error-free.

Limitations of Liability

To the fullest extent permitted by law, SkinNit, CC Entertainment PTY LTD, and our directors, employees, or agents will not be liable for indirect, consequential, incidental, special, punitive, or similar damages arising from your use of the Site or products, even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, and expenses arising from your use of the Site, your submissions, your breach of these Terms of Service, your violation of third-party rights, or your violation of applicable law.

Electronic Communications

By visiting the Site, sending emails, using online forms, or completing transactions, you consent to receive electronic communications from us. Electronic notices, policies, records, and communications satisfy any legal requirement that such communication be in writing where permitted by law.
